We recently obtained class certification and successfully opposed a motion for summary judgment in a case against EF Education First concerning its failure to pay overtime to its tour consultants. Our claim in that case is that EF has misclassified as tour consultants as administrative employees who are exempt from overtime, but that the tour consultants qualify to receive overtime pay under state law.
