Judge rules retaliation case against Gordon College may proceed

Judge Salim Rodriguez Tabit for the Essex County Superior Court has denied Gordon College’s motion to dismiss a plaintiff’s retaliation case based on the so-called “ministerial exception” to Massachusetts’ anti-discrimination laws. Judge Tabit concluded that dismissal was inappropriate at this juncture because the parties disputed whether Gordon College was a religious institution, whether the plaintiff was a religious teacher, and whether Gordon College was engaged in expressive association central to its mission.
